The Party Wall Act provides the framework for preventing and resolving disputes in relation to party wall matters, boundary walls and excavations near neighbouring buildings. If you are a building owner and intend to carry out building work which involves:
- work on a wall shared with another property; or
- building on the boundary separating a neighbouring property; or
- excavating near a neighbouring building
If it is, you are legally bound to notify all adjoining owners (which include freeholders and leaseholders) whose property will be affected by the proposed works.
The process is straightforward, but without expert advice at the outset you may waste valuable time, fall out with your neighbours or face legal action should you be found in breach of the Act.
